Understanding Real Property vs Personal Property: Definition and Examples

Which is not real property?

While drapes are personal property and need to be specifically written in the contract, the hardware on which the drapes are hung is a fixture. The dishwasher is built in, the sump pump is attached through a hole in the floor, and the swimming pool is in the ground. Therefore, all these are affixed and are real property.

Personal property such as cars, furniture, clothing, and other movable assets is not considered real property. Real property refers to land and any permanent structures or improvements attached to it, such as buildings, homes, and fences. Other examples of real property include mineral rights, water rights, and easements.
