Two kinds of compensatory damages
special and general
Compensatory damages are a type of legal remedy whereby the plaintiff receives monetary compensation or reimbursement for losses or damages suffered as a result of the defendant’s misconduct. There are two main types of compensatory damages:
1. Special or economic damages: These are damages that result directly from the defendant’s misconduct and can be quantified or calculated. Examples of special damages include medical bills, lost wages, property damage, and any other financial losses incurred by the plaintiff as a result of the defendant’s actions.
2. General or non-economic damages: These are damages that are more subjective and difficult to quantify but still compensate the plaintiff for harm they have suffered. Examples of general damages include pain and suffering, emotional distress, loss of enjoyment of life, and other intangible losses. These damages are typically awarded in cases where the plaintiff has suffered physical or emotional harm due to the defendant’s actions.
